Acceptance
These Terms govern your access to and use of the Nostara mobile application and related services (the “Service”). The Service is provided by Nostara Team (“Nostara,” “we,” “us,” or “our”).
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility (17+)
The Service is intended for users age 17 and older. By using the Service, you represent that you are at least 17 years old and that you have the legal capacity to enter into these Terms.
The Service
Nostara helps you organize and celebrate cherished memories by turning photos, notes, and keepsakes into curated stories. The Service may include “AI-powered” or “smart” generation features. You choose whether to use these features and whether to upload any content for processing.
Accounts
- You may need an account to use certain features.
- You agree to provide accurate information (such as name, username, and email) and keep it up to date.
- You are responsible for safeguarding your credentials and all activity under your account.
- Notify us promptly if you suspect unauthorized access.
Your content
Ownership: You retain ownership of the content you upload, submit, store, or create through the Service (“User Content”).
License to operate the Service
You grant Nostara a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and display your User Content only as necessary to provide, maintain, and improve the Service and to perform the actions you request (such as generating a story from your inputs).
You are responsible for your User Content and represent that you have all rights necessary to upload it and grant the license above. Do not upload content that is illegal, infringes others’ rights, or violates these Terms.
Acceptable use
You agree not to:
- use the Service for unlawful, harmful, or abusive purposes;
- attempt to gain unauthorized access to accounts, systems, or networks;
- interfere with or disrupt the Service (including reverse engineering, scraping, or bypassing security);
- upload malware or code designed to harm systems;
- harass, threaten, or exploit others; or
- violate intellectual property rights or privacy rights of others.
We may remove content or restrict access if we reasonably believe it violates these Terms, the law, or the safety of the Service and its users.
Privacy
Our collection and use of personal information is described in the Nostara Privacy Policy. If there is a conflict regarding personal information, the Privacy Policy controls.
Third-party services
Your use of the Service may also be subject to third-party terms (for example, Apple’s App Store terms). We are not responsible for third-party services or their content.
Changes & termination
- We may modify, suspend, or discontinue the Service or any feature at any time.
- You may stop using the Service at any time.
- We may suspend or terminate access if you violate these Terms or if needed for safety or legal compliance.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
To the maximum extent permitted by law, Nostara disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, Nostara will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Service.
To the maximum extent permitted by law, Nostara’s total liability for all claims related to the Service will not exceed the amount you paid to Nostara (if any) during the 12 months before the event giving rise to the claim.
Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless Nostara from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.
Governing law & dispute resolution (binding arbitration)
These Terms are governed by the laws of the jurisdiction where Nostara Team has its primary place of business, excluding conflict-of-law rules.
Binding arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration, not in court, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information.
- The arbitration will be conducted in English by a neutral arbitrator.
- The arbitrator’s decision will be final and binding, and judgment may be entered in any court with jurisdiction.
